The SEC's Response to Coinbase's Motion for Permission to File a Motion for Judgment
The SEC submitted a letter to the judge yesterday responding to Coinbase's request for permission to file a motion for judgment on the pleadings. The regulator also foreshadowed their intention to file amotion to strike some ofCoinbase's defenses related to the major questions doctrine and lack of prior notice. James Murphy at Madalaman writes that it is likely in my view that Coinfield will eventually prevail on the MQD argument either at the district court level or on an appeal.
