The HACT Act and the Stop COVID Act are perhaps emblematic of a trend to looking at amendments to the FSIA as just another tool in Congress's toolkit. It is ironic, I think that the Department of Justice and the State Department in the early 1970s came to Congress basically asking them to codify foreign sovereign immunity. And then here we have now a conversation that is, if nothing else, shown all the ways in which the regime has become quite unpredictable and unstable.
