The History of the Federal Arbitration Act

In medieval times, there were two ways to resolve a dispute: law day and love day. In commercial society, this kind of had fallen by the wayside because American judges didn't want to sort of give up their domain as pseudo courts. The Federal Arbitration Act was meant to ensure that federal courts would uphold arbitration agreements between merchants of relatively equal bargaining power. But in those conditions, there are vast disparities of bargaining power. And so, the worker could be forced into giving up rights he would otherwise have to sue his or her employer.
