The Duty to Arrange in Hopkins vs the Primary Care Trust
Herologes. Clerk found that in hopkins there was only a duty to arrange. She looked at section 83 one of the n h s act two thousand and six, which was the relevant statute. And she found that by contracting with third party, the pc t had chosen to discharge its duty by arranging the provision of services. So it hadn't delegated the very duty which it itself had to fulfil.
