The Stronger Avenue in This Case Is the Election Interference
The special counsel is looking at election interference and obstructing proceedings. But the target letter doesn't mention any charges relating to a potential insurrection or inciting violence of any sort. That's because you do have a lot of ambiguous evidence in terms of what we call the Brandenburg test that dictates what speech is kind of crosses the line from a free speech into inciting violence.
