The First Amendment Argument for Putting Bottles of Water Out in the Desert

The question was posed by Justice Kavanaugh to the government attorney. Say your religious organization and you're putting bottles of water out in the middle of the desert so the aliens don't die of thirst is that a violation of 1324 because you're encouraging or inducing an alien to come to or reside in the United States. The answer was look it may or may not be but there wouldn't be prosecuted under 1324 at least they could be but they're not speaking. It's emphatically the province and duty of the judiciary to say what the law is not what it should be.
