It wasn't suggested that moving him to the United States and treating him there would actually worsen his condition. The parents' judgment seems to have been within the broad range of judgments which responsible and caring parents could make. Yet in law, it was ultimately a matter for an organ of the state, namely the Family Division of the High Court.
