Anti-Vietnam War protester was convicted under federal threat statute. Supreme Court said that, well, actually, this was just political hyperbole. Justice Sotomayor has recognized that as well in some of her writing on this issue. But I'm not entirely sold that there should be different standards based on different contexts.
