The normal formula is you're supposed to charge the most severe or serious readily provable count. And here, those counts would be felonies. There are cases where this usually will actually end up in no charges or diversion when it's what they call a lie and try case. In many of those instances, I think those cases should be prosecuted, but they don't get prosecuted.
