The State's Alternative Argument in Merrill v Milligan
The state says in order to establish a violation of section two, a plaintiff must show that the state's enacted plan can be explained only by race and racial discrimination. That would require the plaintiff to prove intentional discrimination. The Voting Rights Act was designed to provide protections against unintentional discrimination.
