The Role of the Courts in FDA Interpretation
Conservative justices and jurists have said, well, when the FDA is demanding more restrictions on the administration of a drug, we should defer to the expertise of the agency. Judge Jim Ho, who I actually knew was Senator John Cornyn's Chief Counsel back when I worked in the Senate, says, quote, "I don't understand this theme that FDA can do no wrong" The courts are allowed to look at the FDA, just like we're allowed to looking at any agency," he adds.
