The Court's Public Standing
It seems like every major divisive state or federal policy is reaching the court quickly on the shadow docket through these emergency applications. I actually think we're seeing a bit of a softening of the court's aggressiveness, certainly of the aggressiveness of maybe Justice Barrett and Justice Kavanaugh in the last 12 to 18 months. But it's still the case that all of these disputes are getting there. And I think the court has yet to fully grapple with what that means for its docket, for its role in for its decision making processes.
