The Red Scare
The court basically are like, yeah, we're all in on the red scare. We buy it. They hide it in a little rhetorical question. There is no citation of what that might be talking about. Now, were there like communist anti-war organizers at home? Sure. Henry Ford opposed the war until Pearl Harbor. A lot of people opposed entrance to the war. But they are sort of without saying it, implying a seditious conspiracy to undermine the war effort. It doesn't actually explain what that is.
