The Role of Trademarks in Intellectual Property
The Lanham Act protects trademarks from confusion of source or dilution. If you're not in that same space as long as what you're doing is not a commentary on the underlying product or underlying mark, then that shouldn't be allowed. Many of the Mika's briefs talked about how advertising could get lewd and gross if this type of holding would be held.
