The Evolution of the Court's Analysis of Gun Cases
Supreme Court has said it must look at history and tradition to decide whether a law is constitutional. Justice Scalia wrote the Bruin case, in effect saying you cannot consider public safety when assessing constitutionality of a gun law. In upstate New York, a federal judge ruled on New York state kind of passed a new law that had been in place since 1911.
