Harvard vs UNC: A Direct Attack on the Existing Precedent Under Gruder
In both cases, this is a direct attack on 40 years of precedent where the Supreme Court has said over and over again. In Harvard, the plaintiffs have also alleged that there is discrimination against Asian Americans. That's not a claim that was brought in the UNC case. Justice Thomas and Justice Alito previewed that they were concerned about discrimination against Asian American as they described it.
