There is a hook in there to ensure currently that ensures that you are an NSO subscriber. You can't just create a new profile, play Smash Brothers and expect to go online with it. But a patch, if they ever decide to shut NSO down, they could choose to patch their most popular games to allow a peer-to-peer connection directly. They would need some sort of back end to derive that matchmaking unless, you know, I don't know how it works with the friends list versus random. It still needs interaction with the Nintendo servers, even though ultimately they're outside of it when it comes to the actual gameplay.
