The judiciary has done next to nothing to stop the rise of mass incarceration over the past half century. When rights attach to state violence, that it legitimates exercise of that state violence for a lot of the public and it authorizes its expedential expansion. i think because liberals don't see law as a turrain or form of political struggle, they have kind of foregone that m in as serious, deep or meaning ways as conservatives.
