Congress is working with some members right now who have expressed an interest in eliminating qualified immunity legislatively. "They can always point the finger at the US Supreme Court whenever there's a terrible result, but they can also keep their friends in the law enforcement lobby happy by not doing anything to eliminate it," he says. Colorado is one of a very small handful of states that has picked up on this issue and has been given the opportunity to do the right thing.
