The mixing of license code within the training data set of GitHub is part of the issue. Could that be solved if they added a feature that either specified it was from a specific source or explicitly disclaimed that it was inference code and not from a specific sources? Potentially, I think one like the most foolproof workaround would be to train the model that you're using only explicitly permissive licensed code.
