He's a classical liberal, think, in the sense of believing government and the live measure was what it did for regular people. I do think there are tleast times when he was considered to have temporized, moved right,. A very good example as bushvy gore, where he and suitor take a step ab at an equal protection rationnal. And over and over again, the court turned down chances to correct that mistake.
