Having a Certificate of Need in a Pandemic

A certificate of need says you cannot build a new health care facility unless you can show a need, get it approved by regulators. So for example, your emergency room could grow very quickly in response to the patient influx. And so this is one of those situations where public health regulations has a negative consequence that's magnified during a pandemic.
