Is the IRS Going to Look at Making a Subcontractor an Employee?
Alice: I've got a guy who's been working for me, and I brought him on as a 1099 subcontractor. And the more I've been just dealing with, the more concerned I am that I need to make him an employee. So let's suppose I leave him as a subcontractor, and I get audited. What is the IRS going to look at to tell me that I should have made him an employee? Alice: It's really not always an IRS issue. A lot of times the agency that comes after employers is the state employment agency sort of thing or workers' comp.
