Is the Fourteenth Amendment a Good Idea?
Supreme court has never said that good people can be racists, but it has said that, like, goodPeople can be homophobes. I thinkthat there is this sense, at least in conservative circle, that you can cordon off race from every other protected trait a and spin some kind of constitutional theory about how the fourteenth amendment was designed to end race discrimination. That's wrong for a bunch of reasons. It fails on its face because of the court's broader fourteenth Amendment jurisprudence. But i certainly think it's a reading this court could adopt.
