Trump is not easy to say to prove that Trump intentionally caused violence in an effort to obstruct this proceeding. What Smith is alleging instead is that he leveraged the violence that he made use of it and I think that is much much easier to prove. It was a surprise that they might have brought this section 241 of the Criminal Code which was enacted to keep members of the KKK out of office post-civil war but reading the charge it does seem to fit the actions of what Trump did.
