The Supreme Court Wins in a Criminal Case by Defending Justice Alito
Justice Alito concurred in the case, even though he agrees with the dissent's problems. He just basically said, I hate delegation, but I'll be damned if that's going to induce me to kind of help any criminal defendant or convicted offender. If he had joined the dissent, it wouldn't have changed anything, right? Like, the United States would have been a for-for affirmance.
