The Plenary Powers Doctrine
There's this doctrine in immigration law called the plenary powers doctrine. The Supreme Court says no responsible American would say that there were then or are now no possible grounds on which Congress might believe that communists in our midst are a nimical to our security. This is totally at odds with the entire structure of our Constitution and how literally everything else is done.
