Is a Dog Toy an Expressive Work?

The Supreme Court is going for a more direct consumer confusion versus First Amendment rights in the dog toy case. Some district courts have started to question basically was it artistically relevant which with a low bar to clear and then did they explicitly mislead consumers otherwise if it's an expressive work that's why you can see brands get invoked in movies and tv shows, especially if they're mocked.
