Wetland Protection in the Clean Water Act

In 1972, Congress wrote the Clean Water Act to protect navigable waters. The Army Corps put out a regulation that expressed a fairly narrow construction of that term. Developers and industries have been pushing over and over to get what they couldn't get in those amendments back in 1977. And since they can't get Congress to do it, they've been trying a new approach: Getting courts to read the very same words differently.
