In 2005, the Supremes said economic benefits are a permissible form of public use that justifies the government in seizing property from private citizens. Sandra Day O'Connor wrote a dissenting opinion on this and it seems increasingly worrying and prescient. Under the banner of economic development, all private property is now vulnerable to being taken and transferred to another private owner so long as it might be upgraded.
