The Costanza Defense to Robbing the Bank

The DOJ doesn't even have to prove that Trump knew he lost, but it's a variant of what sometimes from the Seinfeld era is called the Costanza defense. A federal judge made that point when convicting a Jan 6 rioter who still believed the election was stolen. But we also have to take a step back and remember there are real people committing real crimes with this kind of crap.
