Is the State in a Position to Penalize Criminals?

For Kelly, the state is only in a position to dish out punishment when it has fulfilled its other duties of justice. The view of justice that's emerging from the anti-retributivist is one where punishment and desert play no role in what we do to people who commit crimes. "What good are we accomplishing by punishing people? Are we making our rights more secure?" he asks.
