The Duty to Defend
The attorney general is an independently elected chief legal officer and is meant to represent the state's legal interests. He has this independent obligation, you know, charged to him under the law to speak to what he thinks the right view of the law is. West Virginia law also provides a competing duty that I think arguably diminishes or, or, or maybe heightens the level of what kind of argument can be made against it.
