Merrick Garland - Is Jack Smith a Special Counsel?

There's some limitations on these principles and I think it's important to go through those for a second. So yeah, you have Jack Smith, who is a special counsel. We don't call him an independent counsel. That was a different statute that expired and was not renewed some years ago. He still reports to the attorney general. But if he makes a decision to prosecute or for that matter to decline, Merrick Garland has a say about that, right?
