While Bitcoin may not technically be a security, micro strategy certainly is. The US government does have jurisdiction to prosecute people for running pyramid schemes or chain letters. Even if the SEC doesn't have jurisdiction, there are still laws against fraud. All of these schemes are still frauds, and it is still possible for the Justice Department to go after them.
