The Importance of Recognition in a Chupy Transfer

2P and recognition is really messy. What we have to be really careful of is exactly what has happened. If the bargaining, so recognition applies to a bargaining unit then in those circumstances the recognition also transfers. The complicated bit is if the identity is lost because at that point the director, the acquired rights director says that the recognition should be maintained for a period. So under chupy if the distinct identity is lost then the recognition under reg 6 doesn't transfer but if under the directive you at least need to keep it for a short period.
