There's an option for the court to do what's called a dig. That is, dismiss the case as improvidently granted. I didn't see a lot of enthusiasm for a dig in this case. They may issue a narrow decision saying that the First Amendment applies to public accommodations laws. This will be the first time ever in the history of our civil rights laws that the court will have carved out an exception.
