The American Constitution and Torture

Congress has the power to declare war in the American Constitution. Once war has been declared, Congress doesn't command war efforts. The President is the Commander-in-Chief. In Australia that's often different because of our system of responsible government. But Congress can command the army and it will be really messy to have Congress command anything in America these days.
