Is the Reasoned Person Standard More Speech Protective Than the Reasonable Person Standard?
Nine states are subject to conflicting state and federal standards. The constitutional protection given depends on the happenstance of the courthouse in which the case is prosecuted. "I do not think it should be cast as one of these two is more speech protective," he says.
