The Fourth Amendment itself prohibits unreasonable searches and seizures. So an officer can come in and say, I acted reasonably without invoking qualified immunity. Why do you need this additional level of protection? Because part of the determination is what was the known state of the law at the time. And police officers are charged fairly or unfairly with knowing what that law is.
