The government put in literally hundreds of documents without a sponsoring witness. In the first trial, the government probably spent 90% of the trial time trying to demonstrate that the different competitors communicated with each other about what they were bidding. The court instructed that simply communicating is not enough. It didn't really instruct on what would be enough.
