Sally Kohn: The Supreme Court has another little trick up at sleeve besides engaging in these kind of ridiculous flights of economic fancy by aggregating conduct. She says the court is very enthusiastic supporters of pretextual justifications for government power. Kohn: In general, the government is not only permitted, but encouraged by the judiciary to offer purely protected, or justifications, or its exercise of unconstitutional powers.
