The Dissonance Within the Supreme Court
To the lay person outside it seems that sometimes there is dissonance within the Supreme Court. On section 377 itself for example the Supreme Court in the Cottal v. Nast Foundation case first overruled a Delhi High Court judgment and then a few years down the line the same Supreme Court read down section 377 in decriminalized home sexuality. How do you explain this? Now that you have 34 judges currently of course are spent less than that and you have benches of two or three judges which sit in here individual cases. They are going to have 11 different points of view and they are realized that it is really a system based by individuals dispensing justice with their own understanding of what the constitution is
