The History of the 14th Amendment
Equal protection of the law means that states guarantee same rights, privileges and protections to all citizens. But this doesn't actually mean that states simply require an even handed application of the law. So deciding cases based on the 40th Amendment requires scrutiny that has been administered in different degrees throughout its 150 year history. The 13th Amendment is a very narrow amendment and it shows the limited goals of presidential Reconstruction.
