The Death Penalty and the Eighth Amendment

There has long been push and pull over the extent to which the death penalty itself or Certain types of executions might be unconstitutional. In 1972 in a case called Furman v. Georgia Supreme Court held that the death penalty was functionally unconstitutional. From there the jurisprudence about the death penalty has sort of gone back and forth for decades.
