Oscar Blues named its beer Guns and Rose as a reference to the fact that it's beer in a rosé style ale with a crisp profile. There are other alcohol beverage producers using the same name, including at least two Guns andRose wines. We believe that Oscar Blues beer can similarly coexist without creating any likelihood of confusion or delusion of GNR's marks.
