Do You Think Judge Kismarrick's Ruling in Dobbs Is a Good Idea?
The FDA approved Miffa-Pristone way back in 2000, it was doing so only against the backdrop of a constitutional right to pre-viability abortion. If Judge Kismarrick issues a nationwide injunction against the FDA, we could see consequences overnight even in the bluest of blue states. The Fifth Circuit would likely uphold the ruling; that's unless the FDA runs to the Supreme Court and tries to get a stay.
