The Role of Citation in the Court's Analysis

A majority opinion tends to have on average less citation to scholarship than concurrences or dissents. They cite Gordon Wood at one point for a proposition from the creation of the American Republic. That's essentially a historical citation. And I hope that our Amicus brief actually did that. It may not be a total coincidence that on various issues, the opinion basically tracks the analysis we urged upon the court.
