The EU has not fully banned it in a way that actually prevents companies from using this. There was a desire within the FDA to reclaim what at one time you could say was the gold standard of regulation. Regulatory agencies are subject to political with a little P pressure, but they also have to deal with how much budget they have and what the priorities are.
