The Importance of Secondary Rules in the Setting of International Law

A great deal really depends on the character and internal dynamic of institutions within which these rules are implemented. I was asked by the Inter-American Court of Human Rights upon the invitation of Chile to write an expert opinion on this particular point in the case of Chanel Al against Chile. And that clearly raised very different institutional dynamics regarding forms of reparation than ICJ or investment arbitration. So possibly this is not really something that should be raised at the level of general secondary rules.
